We are committed to complying with our legal obligations regarding the collection, use and disclosure of Personal Information, including any applicable legal obligations under the Privacy Act 1988 (Cth). If we decide to change our Privacy Policy, we will post those changes to this webpage so that you will always know what Personal Information we gather, how we might use that information, and whether we will disclose it to anyone. We may update this Privacy Policy from time to time. Please check this webpage to ensure that you are familiar with the most recent version.

In this Privacy Policy, “we”, “our” and “us” are all references to Net-Cabs Pty Ltd [ABN 22 167 868 859] of F56, 63 Turner Street, Port Melbourne VIC 3207 Australia “Personal Information” has the meaning given to it in the Privacy Act 1988 (Cth). Except as otherwise defined in this Privacy Policy, terms used in this Privacy Policy that are defined in our Oiii Passenger App End User Licence Agreement (EULA) at oiii.com/eula/ have the meanings given to them in the EULA. “Platform” is a reference to the Oiii Passenger App, the OiiiPlus App (for drivers), our website at oiii.com and other related software and applications that have been developed by us or on our behalf.

The following is a brief summary of this Privacy Policy. It does not cover all issues dealt with in this Privacy Policy:

(a) We collect Personal Information from passengers, operators and drivers registered on our Platform and to provide them with technical support and assistance with respect to their use of our Platform and any equipment supplied by us. We also collect Personal Information from potential passengers, drivers and operators who we reject during Registration or who contact us so that we can market our Platform to them.

(b) As a software company, it is necessary for us to collect Personal Information from our passengers and potential passengers, drivers and potential drivers operators and potential operators, employees and contractors, and from other persons who contact us from time to time so that we can identify them and their location, facilitate bookings and Oiiibids via our Platform and as necessary in order for the functionality of our Platform to operate.

(c) We have put in place industry standard security measures to prevent Personal Information from being lost, used, misused, accessed in an unauthorised way, altered or disclosed.

(d) We may use software that we or third parties develop to track and monitor the locations of passengers and drivers who use our Platform. This software is used to track their locations when a passenger books a vehicle using our Oiii Passenger app, when a driver using our platform is driving to collect a passenger and when a passenger is en route to their destination in the vehicle. Data may be collected even if the Oiii Passenger app is operating in background mode. In the Oiiiplus Driver app, location data is collected to identify nearest drivers, dispatch jobs and record trip data. Data gathering commences after starting a shift and terminates after ending a shift. During an active shift, location data will continue to be collected when the Oiiiplus Driver app is moved to the background.

(e) By becoming a registered user of our Platform, or by becoming our employee, contractor or client or providing Personal Information to us, you consent to your Personal Information being used and disclosed in accordance with this Privacy Policy.

Collection, use and disclosure of Personal Information

Sales Information: We may collect Personal Information if it is provided to us for the purposes of enquiries and applications via our Platform, email, application forms or by telephone. We collect this information so that we can communicate with those persons who make enquiries and applications to us in connection with our business. This information is typically limited to contact details that are submitted to us via those channels. We use that information to communicate with those persons and to analyse where, how and when sales opportunities are received by us, to generate and close sales and to improve our sales processes. When engaging in sales related communications, we comply with all applicable laws, including the Spam Act 2003 (Cth). We may also collect Personal Information from public sources, but where practical we will collect Personal Information directly from the person to whom it relates.

Passenger Personal Information: As a software company, it is necessary for us to collect Personal Information from passenger users of our Oiii Passenger App, so that we can arrange and provide them with a tailored experience when using the app, discuss the app with them or answer questions about an experience that they may have in connection with the app or our services when we are contacted by them.

The Personal Information that we may collect, use and disclose of passenger users of the Oiii Passenger App in the course of operating, administering and maintain the platform and our business includes:

  • name;
  • mobile telephone number;
  • photo uploaded to the Platform;
  • email address;
  • preferred payment method including applicable credit card details;
  • IP address;
  • default mood setting;
  • messages between the passenger and drivers pursuant to an Oiii ride;
  • preferred vehicle category and drivers;
  • Oiii ride history and fares;
  • Oiiibids made via the Oiiibid feature that we provide via the Platform (including any Accepted Oiiibids);
  • location (including start and destination locations for each Oiii ride, location while en route during an Oiii ride and ‘favourite locations’ );
  • the times during which they made a booking via the app and the times during which they travelled in any vehicle booked via the app;
  • feedback about the Oiii Passenger App;
  • details of lost property;
  • trip ratings, vehicle review and driver reviews;
  • biometric identification; and
  • For disability subsidy scheme participants only:
    • type of scheme subsidy;
    • disability subsidy card number;
    • disability subsidy card expiration date;
    • a photo copy of the disability subsidy card;
    • date of birth; and
    • sex.

A booking request or Accepted Oiiibid made by a passenger user of the Oiii Passenger App is supplied to the driver who accepts the booking or Oiiibid. The information disclosed to the driver includes details of the passenger’s name and photo (as entered by the passenger into the Oiii Passenger App), disability subsidy scheme, pickup location, destination, trip fare, preferred pickup time and date, preferred vehicle category, passenger rating and mood preference and if it is a driver, whether the passenger would like free WiFi in the vehicle.

Driver Personal Information: he Personal Information that we may collect, use and disclose of drivers in the course of operating, administering and maintaining the Platform and our business includes:

  • name;
  • address;
  • telephone numbers;
  • mailing address;
  • if applicable, IP address (when using the Oiii Driver Tablet);
  • email address;
  • messages between the driver and passenger pursuant to an Oiii ride;
  • location of the vehicle when using the Platform (when driving to collect passengers and when transporting passengers. Such location tracking may also include tracking of the times during which they are traveling for such purposes);
  • if applicable, shifts or times worked (including logon and logoff times from the Oiii Driver Tablet);
  • photos uploaded to the Platform of the driver and the vehicle used by the driver to provide Oiii rides;
  • Oiiibids (including Counter Oiiibids and Accepted Oiiibids) and if applicable, booking fares;
  • record of completed and cancelled Oiii rides and refunds or passenger payments made for each Oiii ride;
  • driver’s licence, driving record, vehicle registration number, VIN number, demerit points summary;
  • vehicle category and details;
  • agreed payment method, payment and financial information such as credit card and/or bank account details;
  • as applicable, a valid driver accreditation, right to work check (VEVO Check), registration of the vehicle as a commercial passenger vehicle;
  • passenger transport licence code and any other equivalent or similar certifications and licences for rideshare drivers;
  • passenger ratings given by the driver;
  • ABN and GST registration number;
  • certificate of currency for insurances;
  • if applicable, taxi licence, Taxi Operator Accreditation Certificate, name and ABN of the taxi driver’s associated taxi operator; and
  • communications between the driver and us (including during our provision of maintenance or support services) and any feedback from the driver in relation to the Platform.

Operator Personal Information: The Personal Information that we may collect, use and disclose of operator users of our Platform (being users that employ or engage third party drivers to drive their vehicles) includes:

  • name;
  • ABN;
  • address;
  • telephone numbers;
  • IP address;
  • email address;
  • vehicle category and details;
  • names of drivers who operate vehicles of the operator.

Statistical Information: We collect statistical information, some of which may be considered to be Personal Information, when a person visits, browses or access our Platform, including the webpages, our applications and our software and how long a user spends on each webpage, app and part of each app and software (Statistical Information). We may use cookies to collect Statistical Information which enable us to monitor traffic patterns and to serve visitors more efficiently if they revisit any part of our website. Statistical Information that we collect may also include technical information such as login information, browser type and version, time zone setting, address, smartphone and tablet location, browser plug-in types and versions and operating system, information about the visit, including the full Uniform Resource Locators (URL) clickstream to, through and from our website (including date and time), page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from a page. We may use data analytics software or services to analyse the Statistical Information that we collect and Statistical Information may include de-identified information that when combined with other information, may result in Personal Information.

In addition to the above circumstances, we may also collect Personal Information where:

  • a person consents to the specific collection;
  • a person becomes a supplier or investor in our company; and/or
  • a person voluntarily provides Personal Information to us (for example, this information may include, name, date of birth, contact details, email addresses, details of our products and services the person chooses to enquire about and other information the person chooses to provide to us).

In addition to using Personal Information that we collect for the above-mentioned purposes, we may also use or disclose Personal Information that we collect for all or any of the following purposes:

  • to administer and manage our business and our legitimate business interests;
  • to manage employee, contractor, supplier, passenger, operator and driver records that we hold about them;
  • in order to process an application or enquiry made to us;
  • when providing information to our insurers, legal, accounting or financial advisors/representatives or debt collectors for debt collection or other purposes;
  • where required by regulators and other authorities including the authority responsible for administering the disability subsidy scheme;
  • where authorised or required by law; and
  • when handling complaints.

Law Enforcement

We may also use or disclose Personal Information to enforcement bodies for any of the following reasons:

  • the prevention, detection, investigation, prosecution or punishment of criminal offences, breaches of a law imposing a penalty or sanction or breaches of a prescribed law;
  • the enforcement of laws relating to the confiscation of the proceeds of crime;
  • the protection of the public revenue;
  • the prevention, detection, investigation or remedying of seriously improper conduct or prescribed conduct; and
  • the preparation for, or conduct of, proceedings before any court or tribunal, or implementation of the orders of the court or tribunal.

Collection of Personal Information from third parties

Where reasonable and practicable to do so, we will collect your Personal Information only from you. However, in some circumstances we may be provided with information by third parties. Where required by law, we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party.

Security of Personal Data

We have put in place industry standard security measures to prevent Personal Information from being lost, used, misused, accessed in an unauthorised way, altered or disclosed.

Where we retain Personal Information in an electronic database, the content will be held in a database at a data centre. The data centres that we use are all located in Australia and implement physical and electronic security protocols and procedures designed to reduce the likelihood of unauthorised access or data breaches. Any other Personal Information that we hold is also stored in databases at data centres that are also subject to physical and electronic security protocols and procedures.

Although we take all reasonable steps to ensure that Personal Information is stored in a secure operating environment, we cannot guarantee the absolute security of Personal Information during its transmission or its storage on our systems.

Further, while we make every effort to ensure the integrity and security of our network and systems, we cannot guarantee that our security measures will prevent third-party hackers from illegally obtaining access to Personal Information.

We have procedures to deal with any suspected or actual Personal Information breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

Junk and Spam Email

We do not send “junk” or unsolicited e-mail in contravention of the Spam Act 2003 (Cth). We will, however, use e-mail from time to time to respond to inquiries or contact clients, employees, contractors and other third parties.

Newsletters

We may send newsletters to our clients, employees, and to operators, drivers, passengers and contractors from time to time. All newsletters contain ‘unsubscribe’ links, which enable any person to unsubscribe from our newsletters by following the relevant link.

If you do not provide your Personal Information to us

If you refuse to provide us with Personal Information or you provide us with erroneous Personal Information, you cannot become a client, employee, contractor of Net-Cabs Pty Ltd or a user of our apps, software or platform because it will not be practical for us to operate our business if we were to allow you to do so.

Retention of Personal Information

We will only retain your Personal Information for as long as reasonably necessary while we have a business relationship with you (or your company), and thereafter where we have an ongoing business need to retain it, as required under law or to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your Personal Information in the event of a complaint or if we reasonably believe there is a prospect it will be required for the purposes of litigation.

To determine the appropriate retention period for Personal Information, we consider the amount, nature and sensitivity of the Personal Information, the potential risk of harm from unauthorised use or disclosure of the Personal Information, the purposes for which we process the Personal Information and whether we can achieve those purposes through other means, and any applicable legal, regulatory, tax, accounting or other requirements.

Destruction and de-identification of Personal Information

We will destroy and/or de-identify Personal Information that we collect where we have legal obligations to do so.

We may, where permitted by applicable law, de-identify your Personal Information (so that it can no longer be associated with you, and is therefore no longer Personal Information) for research or statistical purposes.

Third party websites, plug-ins and applications

Our Platform may include links to third-party websites, plug-ins and applications. Clicking on those links may allow third parties to collect or share data about you. We do not control these third-party websites, plug-ins or applications and are not responsible for their privacy practices. We encourage you to read their privacy policies so that you understand how they may collect and process your personal information.

How to access and correct personal information held by us

To ensure that we only obtain, collect, use and disclose accurate, complete and up to date Personal Information about you, we invite you to contact us and inform us if any of your personal details we hold changes or if any of the Personal Information held by us is otherwise incorrect or erroneous. In certain circumstances, our Platform allow users to update the Personal Information about them and other data subjects that we hold.

It is important that the Personal Information we hold about you is accurate and current. Please keep us informed if your personal information changes during your relationship with us.
